This User Agreement and Terms of Service (the "Agreement") is a legally binding contract between you ("User," "Consumer," or "you") and RenterPass, Inc., a Delaware corporation with its principal place of business in New York, New York ("RenterPass," "we," "us," or "our").
By creating an account, clicking "I Agree," completing the checkout process, or using any feature of the RenterPass platform, you unconditionally agree to this Agreement in its entirety. If you do not agree, do not use the service.
You must be at least 18 years of age, a legal resident or citizen of the United States, capable of entering a binding legal contract under applicable law, and not barred from receiving services under any applicable federal, state, or local law. By using RenterPass you represent and warrant that all of the foregoing is true.
RenterPass reserves the right to modify this Agreement at any time. We will provide at least 30 days' advance notice of material changes via email to the address on your account. Continued use of the service after the effective date of any modification constitutes acceptance of the revised terms.
RenterPass provides a consumer-initiated identity and credential verification platform that enables Users to: (a) request and receive a soft-pull consumer credit summary from one or more Bureau Partners; (b) complete identity verification through a licensed third-party KYC provider; (c) upload supporting financial documentation such as pay stubs, bank statements, and tax records; (d) compile the foregoing into an encrypted Consumer Credential; and (e) selectively share that Consumer Credential with Recipients of the User's choosing via revocable Share Links.
What RenterPass is not: RenterPass is not a landlord, property manager, real estate broker, or housing provider. RenterPass is not a party to any lease, rental application, or housing transaction. RenterPass does not evaluate, score, approve, deny, or recommend any User for housing. RenterPass does not guarantee that any Consumer Credential will be accepted, reviewed, or acted upon by any Recipient.
The RenterPass service is structured as a consumer-initiated model in which you, the User, request your own consumer information, compile it into a Consumer Credential, and voluntarily share it with third parties of your choosing. This structure is legally distinct from a Consumer Reporting Agency (CRA) arrangement as defined under the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq.
Under 15 U.S.C. § 1681b(a)(2), a permissible purpose exists for a consumer reporting agency to furnish a consumer report when requested by the consumer to whom it relates. RenterPass accesses your credit information solely pursuant to this permissible purpose — your own written authorization — and transmits it only to Recipients you designate.
RenterPass does not furnish Consumer Credentials to Recipients on the basis of any creditor or housing-provider request. All data sharing is initiated exclusively by the Consumer. Accordingly, RenterPass does not function as, and does not represent itself to be, a Consumer Reporting Agency under FCRA § 1681a(f).
Nothing in this Agreement limits any rights you may have under the FCRA, including your right to dispute inaccurate information directly with any Bureau Partner. RenterPass is not the appropriate party to receive credit disputes — disputes must be directed to the Bureau Partner that furnished the data.
By completing the RenterPass onboarding process, you provide three separate and independently logged authorizations, each recorded with a timestamp, IP address, and the exact text presented to you at the time of consent:
Each consent is recorded as a separate, mandatory checkbox. Bundled or pre-checked consent is not used. Consent records are retained for a minimum of seven (7) years in compliance with applicable recordkeeping requirements.
You may revoke any active Share Link at any time through your RenterPass dashboard. Revocation of a Share Link terminates Recipient access to your Consumer Credential prospectively but does not delete or retrieve any information a Recipient may have already accessed, downloaded, printed, or otherwise recorded prior to revocation. You may request deletion of your account and associated data pursuant to Section 7.
RenterPass charges a flat one-time fee per Consumer Credential package, as displayed at checkout prior to payment. Fees are processed through Stripe, Inc., a PCI-DSS compliant payment processor. RenterPass does not store, transmit, or have access to raw payment card data.
All fees are non-refundable once a Consumer Credential has been generated. Because the core service — the soft-pull credit inquiry and identity verification — is performed immediately upon payment and the results are delivered to you, the service is fully rendered at that point. You acknowledge that the fee is not contingent upon: (a) any Recipient reviewing or accepting your credential; (b) any Housing Decision being favorable to you; or (c) your credit score meeting any threshold required by any Recipient.
A full refund will be issued if: (a) a technical failure on RenterPass's part prevents the generation of your Consumer Credential within 24 hours of payment, and the failure is not attributable to information you provided; or (b) you request cancellation within 30 minutes of payment before the credit inquiry has been initiated. Refund requests must be submitted to support@renterpass.com with your order number.
Consumer Credentials are valid for 30 days from the date of generation. Renewal of an expired credential requires a new fee. RenterPass will notify you by email at least 5 days before your credential expires. RenterPass does not auto-renew credentials or charge recurring fees without your affirmative initiation of a new purchase.
RenterPass's collection, use, and protection of your personal and financial information is governed by our Privacy Policy, which is incorporated herein by reference. In the event of any conflict between this Agreement and the Privacy Policy, this Agreement controls with respect to data use limitations and the Privacy Policy controls with respect to disclosure practices.
We collect: identity information (name, address, date of birth, government ID number for KYC verification only); credit summary data returned by Bureau Partners (score, trade lines, inquiry history); documents you upload (pay stubs, bank statements, tax records); and access logs (timestamps, IP addresses, device identifiers) generated when Recipients open your Share Link.
RenterPass does not sell your personal data to third parties. RenterPass does not use your Consumer Credential data to make any scoring, rating, or ranking of you as a tenant or borrower. RenterPass does not share your data with Recipients except through Share Links that you explicitly generate and control.
All Consumer Credential data is encrypted at rest using AES-256 encryption with customer-managed keys, and in transit using TLS 1.3. Documents are stored in isolated, access-controlled cloud storage. Raw PII (including Social Security Numbers, if provided to a Bureau Partner) is never stored in RenterPass systems — only tokenized references are retained. RenterPass maintains a Written Information Security Program (WISP) pursuant to the New York SHIELD Act (N.Y. Gen. Bus. Law § 899-bb).
Consumer Credentials and associated documents are retained for 90 days following credential expiration, after which they are permanently deleted from RenterPass systems. Access logs are retained for 7 years for compliance purposes. You may request immediate deletion of your account and all associated data by contacting support@renterpass.com. Deletion requests are processed within 30 days. Deletion does not affect information already transmitted to and retained by Recipients.
California residents have the right to know what personal information is collected, request deletion of personal information, and opt out of the sale of personal information. RenterPass does not sell personal information. To exercise your rights, contact privacy@renterpass.com. RenterPass will not discriminate against you for exercising your CCPA rights.
RenterPass is a transmission intermediary only. Our role begins and ends with facilitating the User's ability to compile and share information that the User already has the right to access about themselves. RenterPass does not:
RenterPass bears no responsibility and accepts no liability for any Housing Decision made by any Recipient, regardless of the content of the Consumer Credential shared, the outcome of any rental application, or any alleged misuse of Consumer Credential data by a Recipient. If you believe a Recipient has discriminated against you in violation of applicable law, your remedy is against that Recipient, not against RenterPass.
RenterPass does not take Adverse Action as defined under the FCRA or NY FCRA. If you are denied housing and believe the denial was based in whole or in part on information in your Consumer Credential, the Recipient — not RenterPass — is the party responsible for providing any legally required Adverse Action notice and identifying the Bureau Partner whose report was used. Your right to dispute inaccurate information runs directly to the Bureau Partner, not to RenterPass.
While Recipients who access Consumer Credentials are required to agree to separate Recipient Terms of Service that prohibit discriminatory use of credential data, RenterPass cannot monitor or enforce Recipient conduct and makes no warranty that Recipients comply with those terms, with fair housing law, or with any other applicable law. RenterPass's Recipient Terms of Service are a contractual mechanism, not a guarantee of Recipient behavior.
The credit score and summary information included in your Consumer Credential is retrieved directly from one or more Bureau Partners at your request. RenterPass does not generate, calculate, modify, or interpret credit scores. RenterPass transmits Bureau Partner data as received and does not warrant its accuracy, completeness, or currentness.
The credit score displayed in your Consumer Credential may differ from scores used by lenders, landlords, or other creditors because: (a) different scoring models produce different scores from the same underlying data; (b) the score reflects data as of the date retrieved and may not reflect subsequent changes; and (c) Bureau Partners maintain their own systems that may contain errors. RenterPass is not responsible for the accuracy of Bureau Partner data and is not the appropriate party to receive disputes about that data.
A high credit score shown in your Consumer Credential does not guarantee, and RenterPass does not represent, that any Recipient will approve your rental application, offer you favorable terms, or make any particular Housing Decision. Credit score thresholds, if any, are set exclusively by Recipients and are entirely outside RenterPass's knowledge or control.
If you believe information in your consumer credit file is inaccurate or incomplete, your right to dispute that information runs directly to the Bureau Partner under FCRA § 1681i and NY GBL § 380-f. RenterPass will provide you with the name and contact information of the Bureau Partner(s) whose data appears in your Consumer Credential upon request, but RenterPass cannot initiate, process, or resolve credit disputes on your behalf.
The credit inquiry RenterPass initiates on your behalf is a soft inquiry that does not appear on your credit report as an inquiry visible to third parties and does not affect your credit score. However, if a Recipient independently initiates their own hard inquiry in connection with your rental application, that inquiry is the Recipient's action, not RenterPass's, and RenterPass bears no responsibility for any resulting effect on your credit score.
Aggregate Cap. In no event shall RenterPass's total cumulative liability to you for all claims arising out of or relating to this Agreement or the service exceed the greater of: (a) the total fees you paid to RenterPass in the 12 months preceding the claim; or (b) $100 USD.
Essential Basis. You acknowledge that the limitations of liability in this section are an essential element of the bargain between you and RenterPass, without which RenterPass would not have entered into this Agreement or provided the service at the price offered. These limitations apply regardless of the legal theory asserted (contract, tort, strict liability, or otherwise) and regardless of whether RenterPass has been advised of the possibility of such damages.
Jurisdictional Limitations. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, RenterPass's liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless RenterPass, its parent, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
Every Recipient who accesses a Consumer Credential via a Share Link is required, as a condition of access, to agree to separate Recipient Terms of Service. Those terms include the following binding obligations on Recipients, which are set forth here for your information:
Enforcement. RenterPass's Recipient Terms are a contractual mechanism. RenterPass does not and cannot guarantee that Recipients comply with these terms or with applicable law. If you believe a Recipient has violated fair housing law or misused your Consumer Credential data, you should consult an attorney and consider filing a complaint with the U.S. Department of Housing and Urban Development (HUD), the New York State Division of Human Rights, or the New York City Commission on Human Rights.
Except as provided below, any dispute, claim, or controversy arising out of or relating to this Agreement, the service, or your relationship with RenterPass — including disputes about the formation, validity, breach, or termination of this Agreement — shall be resolved by final and binding arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures (for claims under $250,000) or its Comprehensive Arbitration Rules and Procedures (for claims of $250,000 or more). The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be New York County, New York.
You and RenterPass agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class action waiver is found unenforceable for any reason, then the arbitration clause shall be void and the parties shall resolve disputes in court.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened misappropriation of intellectual property rights or confidential information. Small claims court actions within applicable jurisdictional limits are also excepted.
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. For any matter not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible.
RenterPass's failure to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by a duly authorized representative of RenterPass.
This Agreement, together with the Privacy Policy and any applicable Recipient Terms of Service, constitutes the entire agreement between you and RenterPass regarding the service and supersedes all prior and contemporaneous agreements, representations, and understandings. Section headings are for convenience only and shall not affect interpretation.
You may not assign or transfer any of your rights or obligations under this Agreement without RenterPass's prior written consent. RenterPass may freely assign this Agreement in connection with a merger, acquisition, or sale of substantially all of its assets, provided that the assignee agrees to be bound by all terms hereof.

Acknowledgment of Agreement. By creating an account and using the RenterPass service, you acknowledge that you have read this Agreement in full, that you understand its terms, and that you agree to be legally bound by it. This electronic acceptance constitutes a legally binding signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN), 15 U.S.C. § 7001 et seq., and the New York Electronic Signatures and Records Act (ESRA), N.Y. State Tech. Law § 302.
